En Roma, el cautiverio conlleva automáticamente la pérdida de la libertad y todas las prerrogativas relacionadas con ella. La condición de un prisionero de guerra legitima todas las formas de tratamiento, porque el prisionero se considera parte del botín. Por lo tanto, se convierte en la propiedad exclusiva e indiscutible del enemigo. En general, los antiguos no cuestionan el poder discrecional del vencedor sobre los vencidos, porque el prisionero de guerra es el esclavo del enemigo. In Rome, captivity automatically leads to the loss of freedom as well as all the prerogatives which are connected with it. The war prisoner’s condition legitimizes all the forms of treatment, because the captive is considered as a part of the booty. Consequently he becomes the exclusive and indisputable property of the enemy. Generally the ancient authors don’t question the discretionary power of the victor on the vanquished because the prisoner of war is the slave of the enemy.
