El trabajo redefine y actualiza el conflicto político sobre el aborto en Argentina a partir del nuevo criterio de justicia que instala el reciente Fallo de la Corte Suprema de Justicia de la Nación. Desde una perspectiva de derechos humanos y de política de género se traza una línea argumental crítica que intenta mostrar que el proceso institucional por el que transita el conflicto, impulsado por el movimiento feminista y combatido por el catolicismo conservador, depende en buena medida de la interacción entre la evolución de los criterios de justicia imperantes en cada momento histórico- político y los cambios en las necesidades de la sociedad que dan fundamento a su aceptación o no como justo. Las reflexiones se inscriben en un sistema capitalista patriarcal con desigualdades estructurales entrecruzadas, principalmente de género y de clase. Se describen los aportes del nuevo criterio de justicia al avance del aborto como derecho y como beneficio de política pública de salud. En segundo lugar, se señalan los obstáculos sistémicos a su ejercicio y las razones que los sustentan y, por último, se enuncian desafíos que deberán transitar la política de género y el feminismo en el camino hacia la despenalización o legalización del derecho humano al aborto. This work redefines and actualizes the political conflict about abortion in Argentina since the new criterion of justice installed by the recent verdict from the Supreme Court of Justice of the Nation. From a perspective of human rights and gender policies, we draw a critical argumentative line that is intended to show the institutional process by which the conflict is passing by, encouraged by the feminist movement and fought off by the conservative Catholicism, it depends to a large extent on the interaction between the evolution of the criteria of justice prevailing in each historical point and the changes in societies' necessities that provide its basis either as fair or not. The reflections are found in a patriarchal capitalist system with overlapping structural inequalities, mostly of gender and social class. Contributions from the new criterion of justice are described to the success of abortion as right and benefit of political public health. Secondly, systemic obstacles to their exercise and back-up reasons are identified and, finally, challenges state that it must undergo gender policies and feminism towards decriminalization or legalization of the human right to abort.
