El derecho de consulta (DC), como mecanismo de participación de los pueblos indígenas afectados por los proyectos de explotación de los recursos naturales, ha sido perfilado en cuanto a su contenido, alcance y finalidad por el Sistema Interamericano de Derechos Humanos (SIDH). El SIDH se encuentra integrado por la Convención Americana de Derechos Humanos (CADH), la Corte Interamericana de Derechos Humanos y la Comisión Interamericana de Derechos Humanos. El principal medio por el cual el SIDH se ha expedido sobre el DC lo constituyen las sentencias de la Corte Interamericana de Derechos Humanos (Corte IDH) en los casos ''Saramaka c/Estado de Surinam'' y ''Pueblo Kichwa de Sarayaku c/ Ecuador''. En el presente trabajo se pretende analizar los pronunciamientos de la Corte IDH sobre el derecho de consulta de las comunidades indígenas a la luz del trialismo jurídico. The right of consultation (DC), as a participation mechanism for indigenous peoples affected by natural resource exploitation projects, has been outlined in terms of its content, scope and purpose by the Inter-American Human Rights System (IAHRS). The IAHRS is integrated by the American Convention on Human Rights (ACHR), the Inter-American Court of Human Rights and the Inter-American Commission on Human Rights. The main means by which the IAHRS has been issued on the DC are the judgments of the Inter-American Court of Human Rights (I/A Court HR) in the ''Saramaka v. State of Surinam'' and the ''Kichwa of Sarayaku v. Ecuador'' cases. This paper intends to analyze the pronouncements of the Inter-American Court on the right of consultation of indigenous communities in the light of legal trialism.
