La cesión de bien determinado es un contrato que tiene la finalidad de trasmitir los derechos hereditarios sobre un determinado bien. El objeto del contrato son los derechos hereditarios, no las cosas. La herencia es una universalidad jurídica. El heredero puede disponer de sus derechos hereditarios. Si hay más de un heredero con el fallecimiento de una persona nace el estado de indivisión hereditaria que se extiende hasta la partición y adjudicación. El artículo 2309 del Código Civil y Comercial de la Nación dispone que no son aplicables a la cesión de derechos sobre bien determinado las disposiciones del título referidas a la cesión de herencia.La cesión de derechos sobre bien determinado produce efectos desde su celebración y legitima al cesionario para reclamar la entrega de la cosa o ser adjudicado. Hasta la partición y/o adjudicación y la entrega de la cosa el cesionario no es titular de un derecho real. Es de mala práctica la inscripción en el Registro de la Propiedad Inmueble de la cesión de derechos hereditarios sin que exista partición y o adjudicación. Es necesario revisar las prácticas consuetudinarias y adecuarlas a las disposiciones del ordenamiento jurídico vigente. The assignment of rights over a specific asset produces effects from its conclusion and legitimizes the transferee to claim the delivery of the thing or to be the successful bidder. Until the partition and or adjudication and the delivery of the thing the assignee does not hold a real right. The inscription in the Real Property Registry of the transfer of hereditary rights without a partition and or adjudication is bad practice. It is necessary to review the customary practices and adapt them to the provisions of the current legal system.
