En el presente trabajo trataremossomeramente de abordar la temática relativa al entendimiento de la violencia doméstica por cuestiones de género como una de las modalidades de la tortura y si ello puede servir para reducir el poder punitivo materializado sobre víctimas de violencia de género diacrónica: a las obligaciones del Estado que se derivan de ese entendimiento adecuado, a la aplicación del derecho con una perspectiva de género en clave de derechos humanos, y, en especial, a la obligación estatal de actuar con la debida diligencia para evitar que esos tipos de violencia se sucedan, agraven y reproduzcan, má- xime cuando ya han sido detectados y abordados por organismos públicos, aún cuando los agresores fuesen particulares. Por último, aplicaremostales estándares al casoY. P. ocurrido en La Pampa en el año 2012, en el cual podremos ver que se ha verificado la intervención ineficaz de una multiplicidad de agencias pre-judiciales en relación a laslógicas que aquí trataremos en torno a una eficaz prevención, investigación, sanción, reparación y erradicación de ese tipo de violencia, y luego la materialización del poder penalsobre una mujer víctima de violencia de género diacrónica que actuó por propia mano contra su agreso In this paper we will try briefly to addressthe issue on the understanding of domestic violence by gender as one ofthe forms oftorture andwhetherit may serve to reduce the punitive power materialized on victims of violence diachronic gender, the State obligations deriving from the proper understanding ofthe application ofthe law with a gender perspective in key human rights and especially the State's obligation to act with due diligence to prevent such violence will happen, fester and play, especially when they have already been identified and addressed by public bodies, even when the aggressors whatsoever individuals. Finally, we apply such standards to the case Y. P. occurred in La Pampa in 2012, in which we can see that there has been ineffective intervention of a multiplicity of pre judicial agencies in relation to the logic here discuss about effective prevention, investigation, punishment, reparation and eradication of such violence, then the realization of the criminal power over a woman victim of gender violence diachronic acted in his own hand against her attacker.
