Estructura y selección de los jueces de la Corte Constitucional. Decisiones limitadas por incidencia de los gobiernos de turno

Abstract

En este artículo se analiza la estructura, las atribuciones y las funciones de la Corte Constitucional, máximo órgano de control e interpre-tación constitucional en el Ecuador. Ello, con la finalidad de determinar si sus decisiones se ven influencias por la incidencia de los gobiernos de turno y del poder político del Estado. La metodología que se utiliza corresponde a un análisis cualitativo, ade-más de la aplicación de métodos cómo el exegético-jurídico, el estudio de caso y el histórico-jurídico, permitiendo un análisis de las normas perti-nentes, así como la realización de un estudio comparado frente a los siste-mas de selección de jueces aplicados por otros Estados en América Latina. Los resultados reflejan la expedición de decisiones por parte de la CC que se generan a partir de su estructura y, sobre todo, por la forma y proceso de selección de los jueces que la integran. Finalmente, se concluye que dicha incidencia se ha visto reflejada en dife-rentes fallos, y en función de eso, se propone un cambio en el sistema de selección de jueces, aplicando un concurso abierto, en vez de uno cerrado, con la finalidad de limitar la influencia del gobierno de turno sobre dicha elección.

This article analyzes the structure, powers and functions of the Constitutional Court, the highest body of constitutional control and inter-pretation in Ecuador. The purpose is to determine whether its decisions are influenced by the influence of the governments in power and the polit-ical power of the State. The methodology used corresponds to a qualitative analysis, in addition to the application of methods such as legal exegetical, case study and his-torical-legal, allowing an analysis of the relevant norms, as well as the re-alization of a comparative study against the systems of selection of judges applied by other States in Latin America. The results reflect the issuance of decisions by the CC that are generated by its structure and, above all, by the form and process of selection of the judges that comprise it. Finally, it is concluded that such incidence has been reflected in different rulings, and based on this, a change in the system of selection of judges is proposed, applying an open competition, instead of a closed one, in order to limit the influence of the government of the day on such election.
