La definición de cuidados paliativos y sus alcances en el derecho argentino

Abstract

En este trabajo me propongo indagar qué se entiende por cuida-dos paliativos (CP) en las leyes y normas jurídicas que regulan y garantizan el acceso a estos servicios en Argentina con el fin de evaluar si se ha recep-tado la noción de CP desarrollada por la OMS y la Asociación Internacional de Hospice y Cuidados Paliativos. Esta investigación nos ayudará a verifi-car si las normas contribuyen o dificultan el acceso a los CP a las personas en situación de vulnerabilidad en razón de padecer sufrimientos asociados a una enfermedad grave. El análisis se centra en cuatro criterios: el alcance subjetivo de los CP, la caracterización de las enfermedades cubiertas, el tipo de abordaje y el es-pectro de problemas alcanzados. Se concluye que la normativa en Argen-tina dictada sobre CP ha reflejado la nueva concepción en torno a estos, aunque subsisten desafíos vinculados con el alcance del Programa Médico Obligatorio y la articulación de los programas de CP para que alcancen tanto a pacientes oncológicos como no oncológicos.

In this paper I investigate what is understood by palliative care in the laws and legal norms that regulate and guarantee access to these services in Argentina to evaluate whether they meet the definition of PC developed by the WHO and the International Association of Hospice and Palliative Care. This research will help us verify whether the regulations contribute or hinder access to PC for people in vulnerable situations due to suffering associated with a serious illness. The analysis focuses on four criteria: the subjective scope of the CP, the characterization of the diseases covered, the type of approach and the spectrum of problems protected. The conclusión is that the norms in Ar-gentina on PC reflect the new conception of PC, although challenges remain linked to the scope of the Mandatory Medical Program and the articulation of PC programs so that they reach both oncological and non-oncological patients.
