El sistema presidencial argentino : bases para la innovación institucional en el S. XXI

Abstract

En el presente trabajo, se abordará el debate entre el sistema parlamentario y el presidencial en el diseño institucional de la Argentina, las características generales de cada uno de ellos y las ventajas y desventajas que presenta el presidencialismo,según las opiniones de distintos especialistas. Se mencionarán los anhelos y objetivos de la convención constituyente de 1994 y los resultados prácticos obtenidos en la reforma constitucional, haciendo hincapié en la figura del Jefe de Gabinete y los poderes legislativos otorgados al Poder Ejecutivo. Luego de evaluar el diseño institucional argentino, y las distintas opiniones y variantes que propone la doctrina, se hará una breve conclusión al respecto.

In the present work, we willsee the debate between the parliamentary and presidential system in the institutional design of Argentina, the general characteristics of each one of them and the advantages and disadvantages presented by presidentialism, according to the opinions of different specialists. We will mention the yearnings and objectives of the 1994 constitutional convention and the practical results obtained in the constitutional reform, with emphasis on the figure of the Chief of Cabinet and the legislative powers granted to the Executive Branch. After evaluating the Argentine institutional design, and the different opinions and variants proposed by the doctrine, we will make a brief conclusion on this.
